Preface :

The Akhil Bharatiya Newar Organisationaims to raise awareness among the Newar community scattered across India through peaceful democratic struggle, revive the ethnic language, script, culture, and traditions, and provide cultural unity to the Newar community, and to provide solutions to the ethnic social anomalies that the Newar community has been facing up to now and will face in the future by analyzing the economic, cultural, and political problems. It is a social organisation that takes appropriate approaches. Since it is a democratic institution, its functioning will also be determined through a democratic process. Since this organisation is dependent on and accountable to the  Newar people/community, its primary work will begin at the grassroots level.

To bring purity to organisational work and to eliminate misconceptions among the people,  the organisation will conduct a sincere review for transparency in organisational work and to eliminate misconceptions among the members. Issues to be considered by  office bearers and executive members are as under:-

a ) Utmost dedicated and devoted leadership

b ) Individuals with progressive thinking.

c ) The eagerness to learn from the general populace and changing circumstances.

d ) Capable of making the utmost sacrifice for the welfare of the organisation.

e ) Priority will be given to those individuals who are conscious, consider duty before self, hardworking, honest and forthright.

Taking into consideration the above-mentioned points,  on 20 June 1993, in the picturesque ”Mirik ” in Darjeeling district, of West Bengal, a formal meeting was held under the joint initiative of Late  Bhaju Jayanarayan Pradhan, Bhaju Arun Bhakta Pradhan and Bhaju Sunil Newar Joshi and entrusted the post of President to Bhaju Arun Bhakta Pradhan and General Secretary to Bhaju Sunil Newar Joshi, and named this organisation as ” Darjeeling Newar Sangathan. To further expand it, the fifth general convention was held at Bagrakot Dooars from 27-29 September 2002 and elected President to Late Bhaju D N Pradhan as President and Bhaju SP Pradhan as General Secretary. The organisation continued the expansion process in various states by naming it AKHIL BHARATIYA NEWAR SANGATHAN(Akhil Bharatiya Newar Sangathan ).

On 03 April 2022, the Sixth General Convention was held in Siliguri and appointed Bhaju Surja Narayan Pradhan as the President and Bhaju Shyam Pradhan as the General Secretary, and formed the Fourth Constitutional Amendment Committee of the AKHIL BHARATIYA NEWAR SANGATHAN. Accordingly, the constitution was prepared by the appointed committee and the 5th Amended Constitution – 2022 was adopted on 27 November 2023 at the Special Representative Meeting of the Akhil Bhatratiya Newar Sangathan Central Committee.

Chapter-1

Article 1 Abbreviation and initials:

(a) The name of this organisation is ‘Akhil Bharatiya Newar Sangathan ‘.

(b) The name of this constitution shall be the Constitution of the ”‘Akhil Bharatiya Newar Sangathan -2022 (with amendments). It shall come into force from the date of approval by the concerned body .

Scope:

(c) The scope of work of this organisation shall be all over India.

(d) Registered number of the organisation is S0019350 of 2021-22, previously

 (S/84129 of 1993 to 2003) (S/IL/17295 of 2003-2004 to 2021)

(e) Registered name of the organisation Akhil Bharatiya Newar Sangathan which will be abbeviated as “ABNS”

(f) Registered Office: OLD SUPER MARKET, 3rd FLOOR, ROOM No.C-41, DARJ DARJEELING.

(g) Head Office: SALBARI, SILIGURI-734009

(h) Established on: 20 June 1993

(i) Founding States: West Bengal, Sikkim, Meghalaya and Assam.

(j) Flag: Made of golden cloth. Deep blue color in the circle in the middle with a golden-colored illuminated ‘ Sukunda ‘facing right in the deep blue round shape .

(k) Measurements of the flag: The flag will be prepared in the ratio of one and a half feet in length and one foot in width. | (3: 2)

(l) Symbol: Ashtamangal.

(d) Meaning of the colors of the flag, the lighted emblem and the symbols:

 (i)  Meaning of the flag colors and symbols: The golden color represents the golden history of the Newar people and their efficiency in the economic prosperity, while the blue color in the circle represents the ability of every caste and sub-caste to establish harmony based on the vast ideology like the sky. The lit Sukunda indicates the tradition in the Newar society to start every auspicious ritual by lighting the Sukunda first .

Ashtamangala- Also called Ashtadal Lotus Leaf, it is considered the form of the entire universe in the Shastras. It is also defined as the form of our subtle body and the eight limbs of yoga viz 1. Yama, 2. Niyama, 3. Asana, 4. Pranayam, 5. Pravyahara, 6. Dharana, 7. Dhyana and 8. Samadhi. It is considered the form of a yantra among the Tantra Mantra Yantras. It is worshipped as the Dharma Chakra viz 1.Srivatsa 2. Pundarika 3. Dhwaja 4. Kalash 5. Charama 6. Matsyayugma 7. Chhatra and 8. Shankha. It is worshipped as the form of the Astha Matrikas viz 1. Mahakali  2. Mahalakshmi 3. Mahasaraswati  4. Indrayani 5. Brahmayani 6. Kumari 7. Vaishna ,and 8 Barahi.

 

Section 2 : Definition:

 Unless the subject or context otherwise requires, in this Constitution:

( a) By “Statute” we mean the constitution of the ‘Akhil Bharatiya Newar Sangathan’.

( b) ” ABNS ” means the ‘ ‘Akhil Bharatiya Newar Sangathan’.

( c) Regulations means the regulations formulated in accordance with the statute .

(d) Committee means the central committee of the organisation. This term also refers to all committees under the organisational structure of the organisation formed in accordance with the statute .

(e) General Convention means the national convention of this organisation. Convention means the state,  district,  Zonal(Aanchalik)(aanchalik) and Branch(Shakha)(shakha) convention under the organisational structure of the organisation .

(f) Meeting means a meeting of the Central Committee of the ABNS. This term also refers to a meeting of a committee under the structure of the organisation formed in accordance with the statute .

(g) Member means all types of members of the organisation.

(h) Annual General Meeting/AGM means the national convention of the organisation . It means the convention of the state, district, Zonal(Aanchalik)(aanchalik) and Branch(Shakha)(shakha) committee of the organisation .

(i) Affiliated Institution: Affiliated Institution means an institution affiliated with the Institution .

(j) Founder: The members who are considered to be the creators of the organisation

( k) Patron : Members who act as guardians of the organisation and are always active in resolving crises in the event of a crisis in the organisation.

(l) Life member means a member who remains in the position of life member in the organisation by paying the prescribed amount.

(m) Entry fee means the amount specified by the Central Committee to be paid for first-time or renewal membership in the organisation.

(n) Monthly membership fee means the amount determined by the committee to be paid monthly to maintain membership of the organisation.

(o) Donation means any voluntary donation made by a Newar member or well-wisher of another community. The amount or item given (cash and kind) should be considered .

(p) Grant means any government / non-government or individual fixed amount should be considered.

(q) The term “organisation” means ” Akhil Bharatiya Newar Sangathan” .

(r) Central Committee: The Executive Committee constituted at the national level of the Akhil Bharatiya Newar Sangathan.

(s) State Committee: Executive Committee constituted at the State level which will be subordinate to the Central Committee

(t) Zone(Aanchalik)​ Committee:  An executive committee constituted by taking the various districts in the zone into account for administrative convenience within each state .

(u) Branch(Shakha)(Shakha) Committee: If there is a sufficient number of Newar families in a village or area and the required number of members are available for the Branch(Shakha)(Shakha) committee, a committee under the Regional(Aanchalik)authority may be formed in such area.

(v) Office Bearers: Incumbent members nominated for the operation and administration of committees formed at each level.

(w) Executive Committee: A committee formed with elected/nominated office bearers to conduct work at each level.

(x) Executive Member: An elected/nominated member for the working and administration of committees formed at each level who carries out the duties determined by the President of the committee to complete programs and plans to be organised in the organisation.

(y) Fund: The lump sum money received by the committee, including entrance fees, membership fees, donations, grants, sales proceeds, inheritance etc, to be kept in the committee’s fund.

(z) Fiscal Year: The fiscal year of this organisation shall be from April 1 to March 31.

Chapter 2

Article 3: Objectives and Tasks (Goals and Objectives)

(1) Objectives: A B N S is the non-governmental and a non-profit public welfare organisation prevalent in India, within the scope of the established laws. This organisation will strive to achieve its objectives, which are as follows:

(a) To instil the pride of being Newars to all the people of  Newar community and to develop and organise the Newar spirit. The Akhil Bharatiya Newar Sangathan is a purely social organisation. This organisation will not have any connection with politics what so ever.  However, Newars of any political affiliation can be accepted membership of this organisation.

( b) To foster a sense of pride in being born as a Newar and to develop a sense of mutual cooperation among Newars.

( c) To protect and promote the importance of Newar history, culture , literature , language, art, music, costumes and to carry out publicity.

( d) To work for the economic, social, educational and cultural protection including promotion and attainment of rights of the Newars.

( e) To conduct various activities that can improve the social , cultural and economic well-being of the Newars.,

( f) To bring uniformity in the prevalent customs and traditions of the Newar community and also try to follow popular traditions like Mha Puja, Kaita Puja, Ihi Sanskar, Indra Jatra  etc.

( g) To prepare and implement visions and welfare plans for the social upliftment of the Newar community.

(h) To protect the movable and immovable property of the organisation, to use it for the fulfillment of the goals and objectives of the organisation and for the development work of the organisation .

( 2) Tasks: Tasks to be carried out to achieve the objectives of the organisation:

( a ) To conduct necessary programs and campaigns at the national and local levels from time to time to raise awareness among the Newars for the upliftment of language, literature, customs and culture.

(b) To organize training, interaction, seminars, conferences from time to time for the protection and promotion of the language, script, art, customs, festivals, costumes, cuisines etc. based on the ethnic identity of the Newars.

(c) To build thematic organisations, to form Newa Bhayanu Guthi, Yuva Guthi, Visa Guthi.

(d) To undertake various activities for the economic, social and cultural advancement of the Newars through affiliated organisations.

( e) To conduct trainings and seminars for the promotion , protection and promotion of language , script and culture ,

(f) Collecting donations, contributions (fees) for the organisation,

(g) To carry out all such other relevant matters as may be deemed necessary to assist the organisation,

(h) Provide assistance to illness, accident and death of members of the organisation as needed and to  support poor and meritorious students,

(j) All income and movable and immovable property earned or received by the organisation shall be used for the fulfillment of the goals and objectives of the organisation and for the development of the organisation. No part of the property or assets of the organisation shall be paid, distributed or distributed among any of the members as a profit.

(j) To purchase, construct or make necessary arrangements for movable and immovable property required by the organisation.

Chapter 3

Article 4 : Membership

  1. 1. The type of membership offered by the organisation will be as follows:

( a) Founder Member

( b) Ordinary Member and

( c) Life Member

  1. Provision of Membership fee

(a) Membership will be provided to those who follows or is willing to follow the traditions, culture, customs and rituals of the Newar community and who is obliged to obtain an identity card by paying the fee etc. as prescribed by the organisation will be considered a member.

(b) After accepting membership, the fee prescribed by the organisation must be paid regularly. The decisions taken by the concerned committee of the organisation must be unanimous. The organisation’s constitution and management regulations must be accepted in writing and duly followed .

(c) Only a qualified person from each Newar family can be a member of the organisation. In case of separation from the family of the primary member, separate membership will be taken.

( d) Individual applications for admission of new members shall be submitted only to the local Branch(Shakha)(Shakha) committee. There shall be no provision for admission of membership in the offices of the Regional(Aanchalik), State and Central Committees . However, after granting membership, the approval of the Regional(Aanchalik)and State Committees shall be mandatory .

(e) If any doubt arises in the process of granting membership, the Branch(Shakha) Committee will consult with the Regional(Aanchalik)Committee and take a decision. If necessary, the Regional(Aanchalik)Committee will consult with the State Committee and the State Committee will take a decision .

(f) The concerned Branch(Shakha) committee shall be fully responsible for the admission of new members . If any social or legal problems arise due to the membership of any member, the concerned Branch(Shakha) committee shall be fully responsible .

(g) No Branch(Shakha) committee shall be subordinate to another Branch(Shakha) committee . The Branch(Shakha) committee may maintain direct contact with the Regional(Aanchalik)Committee and, as necessary or depending on the circumstances, with the State and Central Committees .

(h) Every member must give utmost recognition to the saying that ” a nation is kept alive by its culture ” .

( 3) Founder Members.

( a) The organisation was established on 20th June 1993 in Mirik in Darjeeling district, and for the first time in the history of the organisation, on 20th June 1996, on the occasion of the Foundation Day celebration at the Tourist Lodge in Mirik, this organisation evaluated the following members: Mr. J.N. Pradhan (Soureni) , Mr. A.V. Pradhan (Mirik) and Mr. Sunil Newar Joshi (9 Mile, Tharbu Tea Estate as the founders of the organisation and were declared as the founding members .

( b) Ordinary Member: The Branch(Shakha) committee may grant ordinary membership to a person who meets the qualifications as per the statute by charging prescribed fee. No committee at any other level other than the Branch(Shakha) committee may grant individual membership .

( c) Life Member: A member who has made a special contribution to the Newar language, art, culture, business, politics, social etc., by charging a prescribed fee .

Article 5 : Qualification of Members

  1. Eligibility for obtaining general membership

( a) Must be an Indian citizen of the Newar community who has attained the age of 18 years .

( b) To agree to unconditionally accept the statutes , policies , rules and guidelines of the organisation .

  1. c) As mentioned in Article 4-2, Sub-clauses a , b and C.

Article 6 : Definition of Life Member

  1. The Central Committee will have to contact the Newar Bhaju and Mayju who have a spirit of social service and have desire for the upliftment of the Newa community across the country should urge them to accept ” lifetime membership ” .
  2. One can become a ” lifetime member ” of the organisation by paying Rs. 25,000/- (twenty-five thousand only) to the Central Committee . ‘ ‘ Lifetime membership ” shall be considered a life member of the ” Akhil Bharatiya Newar Sangathan” . The said amount will increase over the period of time .

3) Members who accept lifetime membership will be provided with a certificate and the organisation’s ” Lifetime Membership Certificate ” by the Central Committee .

4) The amount received from the lifetime membership fee should be deposited in a nationalised bank as a fixed-term revolving fund and should be approved by the general meeting or the Central Committee. Upon approval, its interest can be spent on specific projects .

5) The following benefits / rights will be provided after acquiring lifetime membership :-

( a) Exemption from monthly membership fee for life .

( b) Opportunity to hold membership in the Advisory Council will be provided .

( c) May participate in the election of the Executive Committee .

( d) As an honourable guest at meetings or conventions held at all levels.

( e) To advise and assist the Central Committee in making any program to  success.

( f ) Life membership shall remain for lifetime.

Article 7:  Functions , duties and rights of members

( a) To elect representatives for the higher committee.

( b) Active represention in the meetings.

( c) Participating in the election process.

( d) To unconditionally comply with the statute and the regulations, guidelines and circulars issued from time to time formulated under the statute.

( e) To bear the responsibilities as prescribed ,

( f) To provide all possible assistance if the organisation calls for assistance in a special situation .

( g) Any member, being an office bearer of any committee or executive committee or an ordinary member, shall be present and participate in every meeting, understanding that his/her responsibilities are of utmost importance. One should provide support in any way for the progress of the organisation and to keep the organisation strong . One should continue to participate in the organisation’s meetings, even after leaving personal works .

( h) If for any reason one is unable to attend the meeting, it is the first and foremost duty to inform the President in writing or in person before the meeting is held .

( j) One should always be proactive in making any program organised by the organisation a success by providing personal or financial support .

  (k) All members should always come forward to make the programs successful by participating in the meetings organised by their committees, expressing their views and suggestions and making proposals .

Article 8 :  Termination of Membership / Suspension / Resignation

( 1) In case of death of a member , if the member’s membership has been renewed, there will be a provision to allow the deceased’s heirs to maintain the membership for that period .

( 2) No member may resign from basic membership . Only office bearers and members of the executive committee may resign from the assigned position .

( 3) A member shall be ‘ expelled ‘ from the membership of the organisation in the following circumstances :

(a) A complaint for expulsion must have been received by the Central Committee from any committee . There is a provision that the Central Committee may take such action directly regarding the members of the Central Committee .

( b) If it is proven that the organisation’s funds have been knowingly embezzled .

( c) If it is proven that arbitrary funds have been collected in the name of the organisation without the recommendation or approval of the Central Committee .

( d) If any action is taken against the decision taken by the Central Committee or any kind of propaganda is carried out .

( e) If it is proven that the organisation’s constitution and its regulations have been directly or indirectly violated or acted against it .

( f) If convicted by a government court and criminal conviction . Unless the guilt is  proven, subscription will be kept suspended. This step will be taken to nullify negative perception of the general members.

( f) In cases where it is proven that the person has become insane due to a mental illness.

( 4) In such circumstances, a ” show cause ” letter will be issued only after an investigation at a meeting of the Central Committee and if valid reasons are found, there will be a provision for expelling any member of the organisation from membership .

( 5) However, if the expelled member wishes to re-acquire membership, the Central Committee will take a decision . If any fee is outstanding, membership may be re-acquired by charging 100% of the amount or an additional fee as decided . There will be a provision to submit an application form directly to the Central Committee to re-acquire membership .

(6) A person who has been dismissed from membership shall have no claim on the organisation and shall have no claim or right over the organisation’s funds .

( 7) Only the Central Committee can dismiss a member from membership . However, the resignation of an office bearer and executive member can be accepted only by the concerned committee . In such a case, the higher committee must be informed.

Article 9 : Patron

( 1) The Patron shall remain as the guardian of the organisation .

( 2) Patron means the Patron of the Akhil Bharatiya Newar Sangathan.

( 3) The Patrons shall assist by being present at any meeting of the committee.  They will give appropriate advice and suggestions but they will not have voting rights. The acceptance of such advice and suggestions will depend on the decision of the committee. Such advice and suggestions will be converted into action only after their acceptance .

(4)  An active member who has been serving the organisation continuously from the Regional(Aanchalik)level and above for at least five years may be made a patron member based on his knowledge, experience, and dedication.

5) The number of Patrons will not be fixed .

6) The member who assumes the position of Patron shall be issued a certificate of Patronage by the Central Committee of the organisation .

( 7) There will be the following special provisions for the Patrons:

( a) Exemption from monthly membership fees for life .

( b) The opportunity to become a member of the Advisory Council may be available on the recommendation of the Central Committee .

( c) The Patrons shall not have the right to participate in any executive committee elections

Chapter-4

Article 10) General Convention

  1. The General Convention shall be the supreme part of the A B N S. The General Convention shall be held every three (3) years .

  3. Central Committee Office bearers, Executive Members and Advisors

(a) The selected representative elected from the State Committee shall be the representative at the General Convention.

(b) The State Committee shall ensure proportional or proportionate representation from each Aanchalik Committe .

(c) The Central Committee shall publish the notice of the General Convention 60 days in advance and  membership at all levels shall be renewed within 30 days . Thereafter, new and renewed members shall not have the right to elect and be elected or to be nominated or nominated at the General Convention .

( d) A new executive committee of the Central Committee will be formed at the general convention. As per the previous directives of the Central Committee, there will be a provision to dissolve all Branches(Shakha) of the organisation , Regional(Aanchalik)Committees and State Committees whose 3 (three) year term/term of office has expired and shall form a new committee .

( e) The general convention will review the organisation’s activities , achievements , critique the current status of special work proposals and ongoing programs and plans , discuss financial reports and future programs .

 

 

( f) Quorum:

( i) The General Convention shall be presided over by the President of the Central Committee . In the absence of the President, one of the Vice-President selected by the decision of the Central Committee shall preside .

(ii) When discussing any proposal, the decision shall be taken by a majority of the members present in the meeting . However, in case of equality of votes, the President shall have the casting vote .

 

Article 11: Functions, duties and powers of the General Convention

  1. (a) To review , evaluate and approve the work done by the Central Committee .

( b) To approve the proposal for amending the statute and the regulations , policies , and procedural guidelines prepared by the Central Committee .

( c) To conduct the election/selection/nomination of the Central Committee .

( d) To approve the appointment and remuneration of the auditor appointed by the Central Committee .

( e) To pass and approve organisational and financial reports .

  1. The term of office of the Central Executive Committee , State Executive Committee , Regional(Aanchalik)Executive Committee and Branch(Shakha) Executive Committee of the organisation at all levels shall be (3) three years . Within six (6) months of the expiry of the term, the Executive Committee at all levels shall convene an Annual General Meeting ( AGM ) and constitute a new Executive Committee . In case of failure to constitute a new Executive Committee in exceptional circumstances, a Special General Meeting of the Executive Committee may be convened for a term of six (6) months, but in no case shall such extension be granted . Within 1 (one) year of tenure, the formation of a new committee will be mandatory. Annual General Meeting ( AGM) of Branch(Shakha) will be held in the month of April, Regional(Aanchalik)by 15th of  May State Committees by 31st and Central Committee in the month of June without fail.
  2. The Central Advisory Committee may intervene in no conduct of AGM in unforeseen evantualities and take appropriate action/arrangements .
  3. If the situation mentioned in Article 11-2 occurs in the State Committee , Regional(Aanchalik) Committee or Branch(Shakha) Committee, the Central Committee will intervene and take appropriate action and take neccessary measures .

Chapter-5

Article 12:  Formation of the Central Committee and other provisions

  1. There will be a 61-member central committee to determine the policy and conduct the day to day work of the organization. Adequate participation of women members in the committee will have to be ensured.

( a)   A central committee of the organisation will be formed at the central level, consisting of 11 members elected by the general convention of each state committee.

( b) Apart from these elected members, the President of the Central Committee may directly nominate 2 members from the State Committee.

( c) There will be a provision that four such members to be nominated by the Central Committee can be taken from the active members of any committee within the state.

( d) Every three years, the office bearers will be elected constitutionally. For the election of office bearers, each state committee must hold its general meeting/session in time and send the list of representatives for the central committee to the central committee.

( e) Before the general meeting/session of the Central Committee, the accounts of all the committees formed at each level must be audited as per the instructions of the Central Committee, and a written report of this must be submitted to the Central Committee.  After conducting an internal audit of the income and expenditure accounts, the branch committees must submit a report (balance sheet) to the central committee by April, aanchalik/district committees by May 15, and state committees by May 31.

(f) Any member may be a member of only two levels of committees.

  2) Details of Central Committee Officers and Executive Committee:

( a) President –                      1

( j) Executive members will be formed as needed.

( j) In other states where the organization’s committee is not fully formed, the President shall nominate 2 (two) permanent invited members with the aim of establishing contacts and expanding the organization in the future. However, they shall not have voting rights.

 

 

Article 13: Functions , Duties and Powers of the Central Committee :

(a) To make policy decisions on matters necessary for achieving the objectives of the organisation.

( b) To call the General Convention, determine the topics for discussion and prepare the budget ,

( c) To implement the matters passed by the General Convention.

( d) To prepare the annual report of the organisation and present it at the General Convention.

( e) To contact , consult and seek advice from government , non-government and international donor organisations to achieve the objectives of the organisation .

( f) To coordinate the work of committees under all organisational structures and the work of Newar ethnic organisations .

( g) To contact and coordinate with Newar organisations outside India .

( h) To form various sub committees as per the requirement ,

( i) To form thematic committees as per the requirement .

( j) The Central Committee shall formulate and implement necessary policies , rules , regulations , and guidelines in accordance with the statute .

( k) To form committees and subcommittees as required .

( l) The Central Committee shall nominate up to 3 Patrons if deemed necessary .

( m) Nominate individuals who have made outstanding contributions to society as advisors as needed.

( n) To form an election committee .

(o) The Central Committee shall operate all the State Committees under its jurisdiction .

( p) Make an endeavour to form state committees in various states across the country where Newars reside and arrangements to be made to publicize the organisation’s programs.

( q) To maintain cordial coordination with the Central Government and State Governments and to assist the State Committees in providing facilities to the Newar community who are in below the poverty line (BPL) .

( r) To initiate a plan to provide relief assistance to the Newar community and other communities who are unexpectedly affected by natural disasters and divine calamities .

( s) To provide support and assistance to the families of “martyrs” of any caste or ethnicity who sacrificed their lives for the defense of the country.

 

14) Central Committee Meeting

( a) The meeting of the Central Committee shall be held at least once in 3 months as directed by the President . If the meeting cannot be held for any reason, it may be postponed for 1 month . However, the meeting shall be held at least 4 times a year . Notice of such meeting shall be sent by the General Secretary in writing or by information technology at least 7 days in advance . However, an emergency meeting may be held at any time .

( b) A meeting of the Central Committee shall be called at the request of one-third (1/3) of the members of the Central Committee .

( c) The meeting shall be presided over by the President . In the absence of the President, the Senior Vice President shall preside and in the absence of the Senior Vice- President, one of the Vice- President shall preside .

 

15) Status of membership will not be allowed :

( a) If his resignation from his position is accepted .

( b) If absent from 3 consecutive meetings without notice .

( c) If the Central Committee meeting approves the withdrawal of the invitation with reasonable reasons by the Branch(Shakha) Committee .

16) Functions , duties and powers of office bearers

( 1) Functions , duties and powers of the President :

( a) To assume the responsibilities of office bearers and members , give directions and accept resignations ,

( b) Presiding over the meetings of the General Convention and the Central Committee ,

( c) To appoint and dismiss employees as necessary for the smooth operation of the A B N S.

( d) Representation in national, international and other organisations and institutions as required in relation to the activities of the organisation.

( e) To represent/have represented on behalf of the organisation .

( f) To liaise and coordinate with government , non-government and non-governmental organisations for the benefit and achievement of the objectives of the organisation ,

( 6) In the event of a tie in voting on any matter at the General Convention or Central Committee meeting, the decisive casting vote shall be casted by him .

( h) To conduct/cause inspections and investigations as required in relation to any activities of the organisation .

( j) To maintain and control the movable and immovable property of the organisation.

2) Functions , duties and powers of the Senior Vice President

( a) To carry out the duties and responsibilities assigned by the President with accountability .

( b) To perform all the functions performed by the President in his absence ,

3) Functions , duties and powers of the Vice-Presidents

( a) To carry out the duties and responsibilities assigned by the President with accountability.

( b) To perform all the functions of the President and Senior Vice President in the absence of the President and Senior Vice President .

4) Functions , duties and powers of the General Secretary

( a) To convene the Central Committee meeting and the General Convention meeting as directed by the President.

( b) To submit the annual progress report and the program for the coming year to the General Convention and the annual meeting of the Central Committee on behalf of the Central Committee for decision .

( c) To implement/ensure the implementation of policies passed by the General Convention and Central Committee .

( d) Prepare the agenda of the General Conference and Central Committee meetings, issue notices , record the decisions of the meetings , keep the minutes safe , send certified copies of the decisions of the meetings to the members, and document them .

( e) To perform/cause to perform other duties as assigned by the President.

( f) Providing management , inspection and direction while being involved in the daily administrative work of the organisation .

5) Functions , duties and powers of the office secretary

( a) To be responsible for all the activities of the office as per the directions of the President and the General Secretary.

( b) To keep all types of books , registers , minute books , correspondence files, etc. entrusted to the office safely and responsibly .

( 6) Functions , duties and powers of the Secretary

( a) To fully assist the Secretary General in his work and to perform all the functions of the Secretary General with responsibility in his absence .

( b) To responsibly carry out the duties assigned by the President and the Secretary-General .

7) Functions , duties and powers of the Joint Secretary

( a) To fully cooperate in the work of the Joint Secretary and Secretary .

( b) To act as the Secretary in his absence and perform the duties of the Secretary.

( c) Since the State Committee is selected / nominated as a representative from the State, it shall assist and coordinate the State Committee in implementing the programs approved by the Central Committee .

8) Functions , duties and powers of the Treasurer

( a) To present the annual financial report of the Central Committee, including the audit report, and the proposed budget for the upcoming fiscal year, to the General Convention on behalf of the Central Committee .

( b) The bank account shall be operated by the Treasurer and one of the three persons i.e. the Secretary General , the President and the Treasurer .

( c) Always strive to increase the organisation’s funds .

( d) To have internal and final audit work done.

( e) To keep or cause to be kept records of the movable and immovable property of the organisation .

( f) Books , ledgers , case books, etc. related to the financial transactions of the organisation .

( g) To maintain in accordance with the rules ,

9) Functions , duties and powers of the Co-Treasurer

  1. a) Assisting in the work of the treasurer.
  2. b) In the absence of the Treasurer, the President / General Secretary of the Central Committee shall assume the responsibilities and perform the tasks assigned to him/her .

10) Functions , duties and rights of members

  1. a) Regular attendance at the meetings of the Central Committee ,
  2. b) Actively participate in discussions on the proposals presented at the meetings of the Central Committee and implement the decisions passed .

To responsibly carry out the responsibilities assigned by the Central Committee or the President / General Secretary ,

( d) To provide full support to the Central Committee ,

  1. Duties and powers of the Guardian and Advisory Committee

  1) To provide necessary advice and suggestions to the Central Committee.,

  2) Monitor whether the Central Committee meetings and general conventions have been held within the time period specified in the statute and provide necessary advice and suggestions to the Central Committee .

3) Monitor compliance with the organisation’s statute .

Chapter – 6

Article 18) State convention

  1) Nominate/select the office bearers , members and advisors of the State Committee ,

  2) 35 people from each Regional(Aanchalik)(aanchalik) / district committee with proportional representation or a Branch(Shakha) representative at the Regional(Aanchalik) convention. Each Regional(Aanchalik)(aanchalik) / district committee will nominate or elect a representative to the state convention based on the number of delegates present, whichever is greater, out of the 25:11 ratio. .

  3) There will be office bearers/members of affiliated organisations of the concerned province/state but they will not be candidates and Voting Rights To stay No.

  4) The State Committee shall call the State Convention 45 days in advance . Within this period, new committees of the Regional(Aanchalik)and Branch(Shakha) Committees must have been formed .

  5) Quorum: Quorum of the State Convention:

( a) The quorum for the State Convention shall be 51 percent . If the quorum is not reached for the first time , the quorum shall be the number present at the next meeting .

  1. b) The State Convention shall be presided over by the President of the State Committee . In the absence of the President, the Vice-President shall preside .
  2. c) When discussing the proposal, the decision will be made by a majority of the members present in the meeting . However, in case of a tie, the President will have the casting vote .

Article 19) Functions , duties and powers of the State Convention

  1. a) To study the financial statements and reports presented by the State Committee of the All India Newar Organization and pass them or amend them and pass them.
  2. b) To elect (nominate) state-level office bearers and members .
  3. c) To elect delegates for the general convention .
  4. d) Since the ABNS is a registered organisation and there is a provision for the formation of state committees in various states under the Central Committee, the general and organisational rules will be fully applicable to all state committees and other committees. Special organisational arrangements may be made in a particular state according to the administrative arrangements and circumstances . See Chapter 15. Article 41 : A

 

Section 20) Formation of State Convention and other arrangements

  1) There will be a State Committee consisting of 31 to 51 members to operate the State Committee .

  1. a) President-1
  2. b) Vice President – 3
  3. c) State Secretary-1
  4. d) Treasurer-1
  5. e) Joint Secretaries – 3
  6. f) Executive Members – There will be a minimum of 2 members nominated from each Regional(Aanchalik)(aanchalik) committee or a maximum of 5 members depending on the area of the Regional(Aanchalik)(aanchalik) committee .

2) The term of office of the State Committee shall be 3 (three) years . However, they may be re-elected .

3) The State Committee will be responsible to the Central Committee/State Executive .

4) As per the directions of the President, the Chief Secretary shall normally convene a meeting of the State Committee once in 3 months . Notice of the meeting shall be given to all members 7 days in advance in writing or through information technology, except for special and emergency meetings .

5) If any member is absent from a meeting three times in a row without notice , he/she will be automatically dismissed .

6) To be a candidate for the position of President, one must have completed or be working for at least one term in the State Committee or Central Committee.

7) The jurisdiction of the State Committee shall be throughout the concerned State .

8) If, after the expiry of the three-year term of the State Committee, the convention cannot be held on time due to any reason, there is a provision to extend the term of the current Executive Committee for a period of six months. However , in any case, a convention must be convened and a new Executive Committee formed within one year of the expiry of the term of the Executive Committee .

Article 21) Functions , duties and powers of the State Committee

  1. a) To make policy decisions on matters necessary for achieving the objectives of the organisation .
  2. b) To prepare the annual report of the State Committee .
  3. c) To follow the policies and directives passed by the General Convention / Central Committee / State Convention .
  4. d) Consult and seek suggestions from government , non-government and other organisations to achieve the objectives of the organisation .
  5. e) To supervise , monitor , coordinate and maintain records of the activities of the Regional(Aanchalik) committees and Branch(Shakha) committees under the state committee.
  6. f) Liaise and continuously coordinate with thematic committees and departments within the state ,
  7. g) To form committees , sub-committees , and departments as required and delegate authority.
  8. h) To form a secretariat as required.
  9. i) To appoint advisors from among the intellectuals and distinguished individuals as required.
  10. j) Representation in programs of provincial/state level organisations To do , to cause to be done |
  11. k) To appoint and dismiss employees as required .
  12. l) To conduct an internal audit every year and send the report to the Central Committee ,
  13. m) To perform or cause to be performed other functions as provided for in the statute of the organisation ,
  14. n) If the position of any member of the State Committee becomes vacant for any reason, the position shall be filled for the remaining period .
  15. o) Compile the list of general convention representatives elected/nominated from the state convention and general convention representatives elected/nominated from the Regional(Aanchalik) convention and send it to the central committee .

Article 22 Functions , duties and powers of office bearers

1) Functions , duties and powers of the President

  1. a) To preside over the meetings of the State Convention and the State Committee.
  2. b) Assist in various activities of the organisation.
  3. c) To assume responsibility for the work of office bearers and members , give instructions and accept resignations.

( d) To take care of, protect and control the movable and immovable property of the organization, and to cause it to be taken care of.

  1. e) If any necessary work is found to be urgent and needs to be done while the committee is not meeting, and if the organisation will suffer losses if the work is not done, the work shall be completed and submitted for approval at the next meeting .

2) Functions , duties and powers of the Vice President

( a) To assist the President in his/her work and to perform the duties assigned by the President.

( b) To perform all the functions of the President in the absence of the President.

( c) To carry out / cause to be carried out organisational work in Regional(Aanchalik) and Branch(Shakha) organisations.

3) Functions , duties and powers of the State Secretary

( a) To convene state conventions and committee meetings as directed by the President.

( b) To implement / cause to be implemented the decisions passed by the State Convention and Committee.

( c) To prepare the agenda of the State Convention and Committee meetings , issue notices , record the decisions of the meetings and send the decisions to the members.

( d) To present the annual progress report of the committee and the program for the coming year at the state convention on behalf of the state committee.

( e) To send the report passed by the convention and the program for the coming year to the Central Committee.

( f) Sending the report of the quarterly Convention meeting to the Central Committee.

( g) To take charge of the daily administrative work of the State Committee

( h) To perform other specified tasks.

4) Secretary’s duties and responsibilities and rights

  1. a) Assisting the Secretary of State in his work
  2. b) Perform all the functions of the Secretary of State in his absence.
  3. c) To fulfill the responsibilities assigned by the President or the committee .

5) Functions , duties and powers of the Joint Secretary

  1. a) Assisting the Secretary of State in his work
  2. b) Assisting in the work of the Secretary of State
  3. c) To fulfill the responsibilities assigned by the President or the committee.
  4. d) To work as per the guidelines of the State Committee in the concerned Regional(Aanchalik)Committee , establish coordination , present progress reports in the State Committee meetings , assist and support the work of the Committee.

6) Functions , duties and powers of the Treasurer

,a) To present the annual financial report, audit report, and budget of the state committee for the coming year at the state convention on behalf of the state committee.

  1. b) Maintain the organisation’s daily financial transactions related accounting books , ledgers, etc. in accordance with the rules.
  2. c) To strive to increase the organisation’s funds.
  3. d) Assist in internal audit work.
  4. e) To keep records of movable and immovable property owned by the organization.
  5. f) The bank account shall be managed by the Treasurer and one of the three persons, the State Secretary , the President and the Treasurer .
  6. g) Collect all types of donations , endowments etc. in favor of the organisation , issue receipts for the amount collected. Deposit the collected amount in the bank. Not more than Rs. 10,000 / – (ten thousand) to be kept in hand .

7) Functions , duties and rights of members

  1. a) Regular attendance at meetings and organisation events
  2. b) Actively participate in discussions on the proposals presented at the State Committee meetings and contribute to passing decisions.
  3. c) To responsibly carry out the responsibilities assigned by the President or committee.

Chapter 7

Article 23 Regional(Aanchalik)(Aanchalik) / District Committee

23) Regional(Aanchalik) Convention

1) A Regional(Aanchalik) convention will be held in each Regional(Aanchalik) / district committee area.

  1. a) All officers and members of the Regional(Aanchalik) Committee , members of the Advisory Committee
  2. b) Officers and members of each Branch(Shakha) working committee

( c) Branch(Shakha) representatives designated for each Branch(Shakha) under the Regional(Aanchalik)/ District Committee

( d) If possible There should be 33 percent female representatives among the Branch(Shakha) representatives .

Article 24) Functions , duties and powers of the Regional(Aanchalik) Convention

  1. a) To approve the plan , annual progress and financial report , audit report of the previous fiscal year and the policy , program and proposed budget of the upcoming fiscal year presented by the Regional(Aanchalik) Committee .
  2. b) To elect delegates as specified for the General Convention and State Conventions.
  3. c) Formation of the Regional(Aanchalik) Committee through election/nomination/selection process
  4. d) To form subcommittees as required.

e)The Regional(Aanchalik)Committee will call the Regional(Aanchalik)Convention 45 days in advance .

Article 25 Formation of Regional(Aanchalik)/ District Committees and other provisions

1) There will be a Regional(Aanchalik) committee with 21 to 41 members to operate the Regional(Aanchalik) / district committee .

  1. a) President-1
  2. b) Vice President-3 (one woman mandatory)
  3. c) Regional(Aanchalik)Secretary-1
  4. d) Joint Secretary-3 (one woman mandatory)
  5. e) Treasurer- 1
  6. f) Executive members—may be added or removed as required .
  7. g) State Committee office bearers and members residing in the respective Regional(Aanchalik) committee area will remain

3) The term of office of the Regional(Aanchalik)/ District Committee shall be three years . However, they may be re-elected .

4) As directed by the President of the Regional(Aanchalik)/ District Committee, the Regional(Aanchalik)Secretary shall convene a meeting of the Regional(Aanchalik)Committee generally once in 3 months . Notice of the meeting shall be given to all members 7 days in advance in writing or through information technology, except for special and emergency meetings .

5) Any member who is absent from a meeting three times in a row without notice will automatically be removed from office .

6) To be a candidate for the post of President, one must have completed or served at least one term in the Regional(Aanchalik) / District Committee or Higher Committee .

Article 26) Functions , duties and powers of the Regional(Aanchalik) / District Committee

  1. a) To submit the annual progress and financial report and estimated income and expenditure (budget) for decision at the Regional(Aanchalik) / district convention.
  2. b) To follow the policies and directives promulgated by the General Convention, State Convention , State and Central Committees and get it done.
  3. c) Committees and subcommittees may be formed as required to determine the scope of work and delegate authority to any body or individual .
  4. d) Representing Regional(Aanchalik)level organisations in programs , contacting government offices as needed
  5. e) Represent and liaise with district-level government and non-governmental organisations as needed.
  6. f) Pay the prescribed fee to the Central Committee every year .
  7. g) If for any reason the position of any member in the Regional(Aanchalik) / District Committee becomes vacant, the position shall be filled by nomination for the remaining period .
  8. h) To appoint advisors from among local Newa intellectuals and distinguished individuals as required .
  9. i) To compile the list of representatives for the state convention elected/nominated from the Regional(Aanchalik) / district convention and nominated from the Branch(Shakha) convention and send it to the state committee .
  10. j) Other necessary matters as provided in this statute. To do / have done work.

 

Article 27) Functions , duties and powers of office bearers

1) Functions , duties and powers of the President

  1. a) To preside over the Regional(Aanchalik)/ District Convention and Regional(Aanchalik)/ District Committee meetings ,
  2. b) To form Akhil Bharatiya Newar Sangathan committees in the villages/towns where newar community resides and make them join the organisation .
  3. c) Take necessary initiatives to fulfill the demands of the indigenous people.
  4. d) To give instructions on the formation of the duties and responsibilities of the office bearers and members , and to accept their resignations ,
  5. e) Protect and control the movable and immovable assets of the organisation or cause them to be supervised.
  6. f) If it is deemed necessary to take any urgent action while the committee is not in session, the committee shall If the organisation will suffer losses if the work is not done, the work will be done and submitted for approval at the next meeting. Send |
  7. g) In case of a tie in the meeting, the casting vote will be given.
  8. h) Representing / getting represented in various bodies

2) Functions , duties and powers of the Vice President

  1. a) Assist the President in his/her work and carry out the responsibilities assigned by the President .
  2. b) Perform all the functions of the President in the absence of the President/Vice-President .

3) Functions , duties and powers of the Regional(Aanchalik)/ District Secretary

  1. a) To convene the convention and committee meetings as per the directions of the President .
  2. b) To implement / cause to be implemented the decisions passed in the convention and working committee .
  3. c) Preparing the agenda of the convention and committee meetings, recording the decisions of the meetings, issuing notices and send decisions to members .
  4. d) To present the annual progress report of the committee and the program for the coming year at the Regional(Aanchalik) convention on behalf of the Regional(Aanchalik) / district committee for decision.
  5. e) Send the annual progress report and upcoming programs of the committee, as approved by the convention, to the central and state committees.
  6. f) Sending the report of the quarterly meeting to the State Committee
  7. g) To take charge of the daily administrative work of the Regional(Aanchalik) / District Committee ,
  8. h) To perform other assigned tasks .

4) Functions , duties and powers of the Joint Secretary

  1. a) Assisting in the work of the Regional(Aanchalik) / District Secretary
  2. b) Fulfill the responsibilities assigned by the President or committee responsibly.
  3. c) Assisting in the work of the secretary
  4. d) Regional(Aanchalik)Secretary In his absence, he shall perform all his duties under the direction of the President or the Committee.
  5. e) He/She shall maintain constant contact with the Branch(Shakha) organisation of the region . To coordinate |

 

5) Functions , duties and powers of the Treasurer

  1. a) To be responsible for keeping all accounts of the financial transactions of the organisation ,
  2. b) To maintain the organisation’s accounting books , ledgers , cash books, and all other necessary records related thereto , as per the rules ,
  3. c) Collect all types of donations and donations on behalf of the organisation, issue receipts for the amount received , and deposit the collected amount in the bank . Cash exceeding Rs. 5000/-(Five thousand rupees) shall not be kept in hand .
  4. d) The bank account will be operated by the Treasurer and one of the three members : the Regional(Aanchalik)/ District Secretary , the President and the Treasurer.
  5. e) Present the committee’s annual financial report , audit report, and proposed budget for the coming year at the convention.
  6. f) Assisting the internal accountant
  7. g) Always strive to increase the organisation’s funds.

6) Functions , duties and rights of members

  1. a) Regular attendance at meetings and organisation events ,
  2. b) Actively participate in discussions on the proposals presented in the Regional(Aanchalik) / district committee meetings, bring them to a conclusion , and implement the decisions passed .
  3. c) Regularly visit the designated village/town and submit a report to the Regional(Aanchalik) / district committee .
  4. d) To responsibly carry out the responsibilities assigned by the President or committee .

Chapter 8

Article 28) Branch(Shakha) Committee

1)        Branch (Shakha) Convention

2)        All members of the relevant Branch(Shakha) are advisors

3)        Life members and guardians residing in the respective Branch(Shakha).

 

Article 29) Functions, duties and powers of the Branch(Shakha) Convention

  1. a) To approve the plan , annual progress and financial report , audit report of the previous fiscal year, and the policy , program and proposed budget for the upcoming fiscal year presented by the Branch(Shakha) Working Committee.
  2. b) To form a Branch(Shakha) executive committee from among the representatives.
  3. c) To select representatives for the Regional(Aanchalik) / district convention as prescribed ,

 

Article 30) Formation of Branch(Shakha) Executive Committee and other arrangements

1) An executive committee of 13 to 21 members will be formed to run the daily operations of the organisation ,

  1. a) President – 1
  2. b) Vice-President – 2 (one woman mandatory)
  3. c) Secretary – 1
  4. d) Joint Secretary – 2 (one woman mandatory)
  5. e) Treasurer – 1
  6. f) Executive Member – (Can be added or removed as per requirement)
  7. g) District resident of the concerned Branch(Shakha) , Members and office bearers of the State and Central Committees will remain ex-officio members .

2) In the process of opening a new Branch(Shakha) in a village/city, it can be opened with the encouragement of the nearby Branch(Shakha) and the participation of the concerned Regional(Aanchalik)Committee . In this process, the participation of the executive members of the State and Central Committees (nearby areas) and any office bearers will be considered welcome, but the presence of the office bearers of the Regional(Aanchalik)Committee will be mandatory .

3) The Regional(Aanchalik)Committee will prepare all the details of the newly formed Branch(Shakha) and recommend it to the State Committee for Branch(Shakha) approval . Only after this process is completed and approved by the State Committee, the Branch(Shakha) will be officially recognized. The Branch(Shakha) will be announced as |

4) The term of office of the Branch(Shakha) Executive Committee shall be 3 (three) years . However, they may be fully elected .

5) If for any reason the position of any member of the Branch(Shakha) Executive Committee becomes vacant, the position will be filled by nominating a member from among the executive members for the remaining period .

6) The Secretary shall convene the Committee meeting, as directed by the President, generally every month .

7) The Working Committee may appoint an advisor if it deems necessary .

8) The officers and members of the committee higher than themselves must be invited to the meeting .

9) Only a qualified person from each Newar family can become a member of the organisation.

10) Individual application forms for admission of new members shall be submitted only to the local Branch(Shakha) . There will be no provision for granting membership at the Regional(Aanchalik)/ District , State and Central offices . However, after granting membership, the approval of the Regional(Aanchalik)and State shall be mandatory . It is the responsibility of the Regional(Aanchalik)Committee to provide a copy of the member’s documents to the Central Committee .

11) The concerned Branch(Shakha) committee will be fully responsible for the admission of new members . If any social or legal problems arise due to the membership of any member, the concerned Branch(Shakha) will be fully responsible .

12) No Branch(Shakha) committee shall be subordinate to another Branch(Shakha) committee .

13) Every member must give utmost recognition to the saying that ” a nation is kept alive by its culture ” .

 

Article 31) Functions , duties and powers of the Branch(Shakha) committee

  1. a) To present the annual progress and financial report and estimated income and expenditure (budget) for decision at the Branch(Shakha) convention , and to submit the approved report to the higher committee .
  2. b) Unconditionally implement / cause to be implemented the circulars and instructions issued by the higher committee
  3. c) The purpose of the organisation is to continue working for the future .
  4. d) To make recommendations to the higher committee after distributing the general membership of the organisation .
  5. e) As per the requirement, a toll/ward committee may also be formed in the Branch(Shakha) .
  6. f) Send the list of Regional(Aanchalik) / district convention delegates selected from the Branch(Shakha) convention to the concerned Regional(Aanchalik) committee .

 

Article 32) Functions , duties and powers of office bearers

1) Functions , duties and powers of the President

  1. a) To preside over the meetings and programs organised by the Branch(Shakha) committee .
  2. b) In case of a tie in the meeting, the casting vote will be given .

To prepare proposals to be presented at Branch(Shakha) level meetings and conventions and to implement and cause to be implemented the decisions passed.

  1. d) To supervise , control and protect the movable and immovable property of the Branch(Shakha) committee .

 

2) Functions , duties and powers of the Vice President

  1. a) To perform all the duties of the President in his absence .
  2. b) To fulfill / have fulfilled the responsibilities assigned by the Branch(Shakha) convention .

3) Functions , duties and powers of the Secretary

  1. a) Conducting the daily administrative work of the Branch(Shakha) Working Committee ,
  2. b) To take charge of all the documents of the Branch(Shakha) Working Committee , to submit progress reports , to submit reports and proposals at the convention .
  3. c) To call meetings at the time specified by the Branch(Shakha) committee , and to call meetings at other times as per the advice of the President, depending on the circumstances .
  4. d) To send correspondence to the convention delegates specifying the draft and date of the proposals to be presented at the meeting .
  5. e) Cause to be implemented the decisions passed by the convention and Branch(Shakha) working committee .
  6. f) To perform other assigned tasks .

 

4) Functions , duties and powers of the Joint Secretary

  1. a) To perform all the duties of the Secretary in his absence .
  2. b) To carry out the responsibilities assigned by the convention and Branch(Shakha) work committees.
  3. c) Perform other assigned tasks .

5) Functions , duties and powers of the Treasurer

  1. a) To carry out the functions of the financial fund of the Branch(Shakha) committee .
  2. b) Maintain transparent details of the Branch(Shakha) committee’s income and expenditure.
  3. c) To conduct an internal audit of the financial transactions made by the Branch(Shakha) committee in each financial year and submit it to the convention ,
  4. d) Financial report working committee for each fiscal year
  5. e) To get the proposed budget for the coming fiscal year approved and presented to the
  6. f) To maintain details of the movable assets of the Branch(Shakha) committee ,
  7. g) To perform other assigned tasks .

6) Functions , duties and rights of members

  1. a) Attending Branch(Shakha) committee meetings , participating in discussions and decisions ,
  2. b) To fulfill the tasks assigned by the Branch(Shakha) committee with responsibility .
  3. c) Play an active role in effectively operating the Branch(Shakha) committee .
  4. d) Perform other assigned tasks .

Chapter 9

Article 33) Notification and Quorum: ( Quorum )

The executive assembly/meeting of all levels of the organization can be called by giving (7) days’ notice and emergency assembly meeting. Written notice must be given to each executive member, stating the subject, time, place and date, by giving (24) (twenty-four) hours’ notice. If 1/3 (one-third) of the members of the Executive Committee are present, the constitutional quorum will be reached. If there is a shortage, the members present may wait 30 minutes before the scheduled time and postpone the meeting. The meeting may be adjourned. Once the adjourned meeting is resumed or reconvened, the number of members present at the meeting shall be deemed to constitute a quorum. The Secretary must ensure that each member has received the notice of the meeting.

Chapter 10

Section 34) Motion of no confidence

  1. a) Misbehaved or for acting against the interests of the organisation a motion of no confidence against an office-bearer may be brought in writing by a one-third (1/3) majority of the executive members, and the office-bearer may be removed from office with a 2/3 majority vote .
  2. b) The same rule shall also apply to any other executive members .

c) A person who has been removed from office or membership may reapply for membership

Chapter 11

Article 35) Election

1) Elections at all levels will be held through democratic methods .

2) Elections at all levels will be held as prescribed in the statute . If the election has to be postponed due to any special circumstances, the deadline may be extended by at least 3 months by decision of the Central Committee .

3) The Working Committee will appoint a maximum of 3 election committee members, including the Chief Election Commissioner, for the election, once the date of the general convention is announced .

4) The date of the election will be as determined by the committee at the concerned level and other procedures related to the election will be formulated by the election committee in consultation with the working committee .

Chapter 12

Article 36) Convention:

  1. a) The meeting of the Central Committee shall be held once in three months as determined by the Central Committee or as requested by any state . If necessary, there shall be a provision to hold the meeting even 3 months earlier .
  2. b) Meetings of the Central Committee may also be held in each state on a rotating basis .
  3. c) State committees shall organize quarterly meetings . Meetings may also be organised on a rotating basis among committees under the State Committee.
  4. d) The annual meeting of the State Committee and the Executive Committee of the committees under the State shall be held within two months of the end of the financial year. The General Secretary/Chief Secretary of the concerned committees shall, in consultation with the President, inform the office bearers and executive members of the agenda within 7 days .
  1. Meeting :

This meeting must be called within 10 days if requested by 1/6 of the members of the organisation . No other matters will be discussed in this meeting except the stated agenda . The presence of all members of the executive committee in the meeting will be mandatory .

  1. Emergency meeting:

In case of an urgent situation, the President of the Committee may call such a meeting within 3 to 5 days . Such meetings shall be held only for the purpose of discussing and taking action to resolve the situation . At least 7 executive members (including office bearers) shall be present in this meeting .

  1. Adjourned meeting:

If 1/3 of the quorum is not reached within 30 minutes of the specified time, the President may adjourn the meeting for another 30 minutes . The meeting thus adjourned shall be held for 30 minutes. A quorum will not be required for subsequent re-siting .

  1. General Convention:

The general meeting will be organised only to inform the general members about the activities and programs of the organisation . The office bearers of the central , state and sub-state committees will have to be sent invitation letters in time to attend the general meeting .

Chapter 13

Article 37) Audit and compliance of accounts:

1) The President of the Central Committee will issue an order to have the accounts of the committees formed at all levels within the organisation audited by internal and external accountants.  If the audit is not completed within the specified period, the Central Committee, the State Committee, the Regional (Aanchalik) or the Branch (Shakha) Committee, or a different committee, will intervene, and there will be a provision to present it to the Central Committee. In such a situation, the accounts of the concerned committee will be audited by internal and external accountants, and if a report is received that there is a discrepancy in the accounts, the Central Committee will have the power to dissolve such committees and reconstitute another committee.

  1. The organisation is registered under the Societies Registration Act under section 15 (1) ( a ) ( b ). The institution will maintain all accounts as per the rules and regulations. The institution will have all accounts audited by a qualified accountant.

Article 38) Constitution amendment:

  1. Memorandum and change of rules :

The Memorandum and Rules may be changed, amended, added to or repealed. A special resolution must be passed by a 3/4 majority of the general members of the organisation at a specially convened general meeting for this purpose. The Executive Committee shall have the power to change, amend or repeal the bye-laws and rules as may be necessary for the smooth running of the organisation.

  1. If a controversial situation arises regarding any article of the Constitution, the decision of the Central Committee shall be final and binding.

39) Cases and legal proceedings:

All lawsuits and legal proceedings for or against the organisation shall be in the name of the Secretary General or a person appointed by the organisation.

The organisation shall be dissolved by the vote of 2/3rd of the members in a meeting attended by 2/3rd of the total number of members of the organisation. The movable and immovable assets of the organisation shall be as per the Society Registration Act.

  1. b) To save this organisation as long as the nation survives, it will be the utmost duty of every member to protect it.

Chapter 14

Section – 40) 1. Income Source :

a) Entry Fee : New member​ Entry Fee Rs. 300 /- ( Rupees three hundred ) only .

b ) Monthly membership fee : Rs 50 /- ( Rs. fifty) only .

  1. c) Part Division : Full Entry Fee to the Central Committee.

 (i) Monthly fee to the Branch(Shakha) committee – 60 %

  (ii) Monthly fee to the Aanchalik / District  committee – 20 %

(iii) Monthly fee to the State Committee – 10 %

(iv) Monthly fee to the Central Committee – 10%

  1. d) Donation : As mentioned in chapter 2(para 2) -f

e ) Grant : As mentioned in Section – 2

  1. f) Special campaign : Special Campaigns: Special fundraising campaigns can be conducted by committees at all levels.
  2. g) Central Committee members can voluntarily give an annual donation of Rs. 500/- and more.
  3. h) Executive members of the State Committee may voluntarily give an annual contribution of Rs. 500/- and more.
  4. i) If an office bearer or executive member is on both the central and state committees, the grant will have to be given to only one of the committees.
  5. j) Fund Management:

 1) The State Committee may make other financial rules, except for clauses a, b, and g of Article 40 mentioned in the Constitution.

  2 ) The amount received as a revolving fund(Akshat kosh) can be deposited in a fixed deposit (FD), and its interest will be spent towards achieving the goals and objectives of the organization.

  1. k) Language And Culture Funds –
  2. i) Disaster Management Fund (Relief and Welfare).
  3. ii) Building construction.

iii) Establish other funds as needed.

3) Identity Card: The member’s identity card will be issued by the Central Committee. The identity card will be valid until the membership is renewed.

Chapter 15

1 Article – 41) Miscellaneous: 

a) Administrative structure of the State Committee

Since Akhil Bharatiya Newar Organisation is a registered organisation and there is a provision for the formation of state committees in various states under the Central Committee, the rules of the organisation will generally be fully applicable to all state committees and other committees. If it is inconvenient to adopt a single organisational arrangement due to the lack of a uniform administrative system and environment in all states, other provisions may be made with the prior approval of the Central Committee . Such provisions will be implemented only in the states concerned and will be incorporated into all the constitutions.

Note: It is worth considering what kind of provisions can be made for religious Newars at the end of the various chapters. The organisation has mentioned that caste certificates can be given to followers of other religions. Please see the sub-rule on caste identity cards

Chapter – 16

Article 42

  1. a) The society shall be dissolved by a majority of 3/4 of the members in a general meeting attended by 2/3 of the total number of members of the society. In this situation, the movable and immovable property of the society (Society Registration Act) shall remain as per the Act of the registered society.

b) It will be the supreme duty of every Newar and every member of the organization to save and preserve this organization as long as the nation survives.

Joint report of the President and Secretary-General

Bharatiya Newar Sangathan was formally founded in Mirik, a small town in Darjeeling district, on June 23, 1993, in a joint meeting by Bhaju Jayanarayan Pradhan, Bhaju Arun Bhakta Pradhan, and Bhaju Sunil  Newar Joshi. The President was Bhaju Arun Bhakta Pradhan, and the Secretary was Bhaju Sunil Newar Joshi.

The support of the Honourable Founder Shri J.N. Pradhan (Soureni) as a senior member is commendable. The contributions of many other Newari people are also so numerous it is not possible to include them in this constitution. As this Newar Sangathan began to spread, meetings with various distinguished dignitaries continued. Despite facing difficulties in between, the second convention of this organisation was held at the Kalimpong Rockwell Academy on 23 and 24 December 1995. The complete success of this convention further increased the pride of the organisation.  Apart from organisational issues, the work of showing the forgotten culture of the Newars not only to the Newars but also to the entire public was done here. The participants of this success are the Manka Khala of Kathmandu and the Pasa Muna Puchah of Birtamod and Jhapa. We are expressing our indebtedness to the above-mentioned institutions for their work in culturally awakening Newars like us, who have lost their existence by coming to our side and thus facing the wall. The credit for the success of this convention goes to the President of the Kalimpong Branch Committee, Mr. Bhanubhakta Pradhan, and all his associates. But since the new elections of the organisation could not be held in this convention, on 16.05.96, in the library room of the Darjeeling Gorkha Suffering Prevention Conference Building, Shri A.V. Pradhan dissolved his old committee, and a new Central Executive Committee was formed under the chairmanship of Shri Bhai Chandra Pradhan. The election of the officers of this new committee was as follows:

Achievements of this second Central Committee:-

(a) Celebration of Foundation Day

For the first time in the history of the organisation, it was held on 20 June 1996 at the Tourist Lodge in Mirik. As per the evaluation of this committee, on this occasion, Sarvashree J.N. Pradhan (Soureni), A.B. Pradhan (Mirik), and Sunil Newar Joshi (Nau Mile, Tharboo Tea Estate) were declared and introduced as the founders of the organisation. Mrs. Geeta Pradhan (Darjeeling) and Mrs. Ambika Pradhan (Rimbik) called upon Newar women with the aim of opening a women’s branch. Seeing the enthusiasm and interest of Mrs. Prem Milan Pradhan in this organisation, the convention also entrusted her with the responsibility of coordinator.  Similarly, Bhaju Prem Milan Pradhan (Nagari) was also made the founding member.
